Terms of Service for Work On Purpose With Purpose

**1. Acceptance of Terms**

Welcome to BeckyPlautz.com These Terms of Service ("Terms") govern your use of our website at Becky Plautz. By accessing or using the Website, you agree to comply with & be bound by these Terms. If you do not agree to these Terms, please do not use our Website.

**2. Services Provided**

Becky Plautz provides photography, videography, coaching, & networking to users through our Website.

**3. Privacy Policy**

Your use of our Website is also governed by our Privacy Policy, available at [Link to Privacy Policy]. By using the Website, you consent to the terms of our Privacy Policy.

**4. User Registration**

When you enter your email address information, you will be agreeing to being added into our database for emailing at registration.

**5. Payment & Pricing**

We use PayPal to house our payment & invoicing services for monthly & annual pay options & in some cases one off payments or recurring activity.

**6. Cancellation & Refund Policy**

There are no refunds guaranteed it is the users responsibility to cancel their payments before any recurring payments take place. Monthly services can be cancelled at any time to move forward without recurring payments happening. Annual payments will not be prorated or refunded if user decides to stop services before the year cycle is complete. 

**7. Intellectual Property Rights**

Photos, videos/recordings, & printable material is all under ownership of Rebecca P. Photography & Work On Purpose With Purpose. Sharing of content outside of your personal use is prohibited & we request that all people gain access through registering for the content as a client or member.

**8. User Responsibilities**

If/When user wishes to cancel your subscription or service it is the users responsibility to reach out & assure the cancellation has came through the website & is completed. Upon the cancellation we ask for your feedback to gain knowledge & understanding where we can improve for the future to give more value & support.

**9. Liability & Disclaimers**

Circumstances under which the client/user can terminate the service agreement:

** Client Non-Payment:**
- we may terminate access to produce or services if the user fails to make payments as per the agreed-upon terms or after a specified grace period of recurring payment is due.

** Force Majeure:**
- In cases of unforeseen events beyond the control of either party (e.g., natural disasters, acts of terrorism, or government actions), the service agreement may be terminated without penalty.

** Mutual Agreement:**
- We may agree to terminate the agreement mutually if circumstances change, & both parties no longer wish to continue the business relationship.

** Client Dissatisfaction:**
- If the client is dissatisfied with the services provided & no resolution can be reached, either party may choose to terminate the agreement & no refunds are agreed to take place.

** Insolvency or Bankruptcy:**
- If either we or the user becomes insolvent or declares bankruptcy, it may trigger termination of the agreement.

** Violation of Ethical or Legal Standards:**
- Termination may occur if either party is found to be engaging in unethical or illegal activities related to the services provided.

** Non-Performance:**
- If one party consistently fails to perform their obligations as outlined in the service agreement, the other party may terminate the agreement.

** Change in Circumstances:**
- The service agreement may allow for termination if there is a significant change in circumstances for either party that makes it impossible or impractical to continue with the services.

**10. Termination of Services**

Circumstances under which we or the user/client can terminate a service agreement:

** Expiration of Agreement:**
- The service agreement will automatically terminate upon reaching the specified end date.

** Mutual Agreement:**
- We & the user/client may mutually agree to terminate the agreement if, for example, the client's needs change or they decide to discontinue the service.

** Non-Payment:**
- If the user/client fails to make payment for services as per the agreed-upon terms & after a specified grace period, either party may terminate the agreement.

** Breach of Contract:**
- Termination may occur if either party breaches a material term of the service agreement, such as failing to meet project milestones, delivering work, or violating confidentiality provisions.

** Force Majeure:**
- If unexpected events beyond the control of either party, such as natural disasters, strikes, or acts of war, make it impossible to fulfill the agreement, termination may be appropriate.

** Client Dissatisfaction:**
- If the client is consistently dissatisfied with the quality of work or services provided, they may choose to terminate the agreement without refund of past payments sent.

** Non-Performance:**
- If we, as the service provider, consistently fail to perform your obligations as outlined in the agreement, the client may have the right to terminate without refund of past payments sent.

**11. Confidentiality**

** Data Encryption:**
- We use industry-standard encryption methods to protect any data transmitted between the user/client & our platform, sensitive information, such as payment details, are secure.

** Data Retention:**
- Photography clients images are backed up & stored for 1 year before being deleted. After 1 year of completed service we don't guarantee that your images were saved.

** Compliance with Data Protection Laws:**
- We don't share your information ever.

** Client Responsibilities:**
- All users/clients are responsible for keeping login credentials secure.

** Post-Service Obligations:**
- After you leave the membership you no longer have access to material from within the client portal. After a photo shoot all images purchased are archived after 1 year on a hard drive.

**12. Governing Law & Jurisdiction**

** Wisconsin Laws & Jurisdiction**

"These Terms of Service shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the state & federal courts located within the State of Wisconsin. By using our services, you consent to the personal jurisdiction of these courts."

** Wisconsin Jurisdiction for Wisconsin Clients**

"For clients located within the State of Wisconsin, these Terms of Service shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the state & federal courts located within the State of Wisconsin, and you consent to the personal jurisdiction of these courts."

** Wisconsin Jurisdiction for International Clients**

"For clients located outside of the United States, please be aware that your use of our services may be subject to additional laws & regulations in your jurisdiction. However, for any disputes related to these Terms, the governing law shall be the laws of the State of Wisconsin, without regard to its conflict of law principles. Any such dispute shall be subject to the exclusive jurisdiction of the state & federal courts located within the State of Wisconsin, and you consent to the personal jurisdiction of these courts."
